Federal prosecutors are urging a judge to leave Michael Eloshway's child sexual abuse material conviction and prison term untouched after the reality star asked the court to throw them out.

Court filings say the "90 Day Fiancé" alum argues his trial lawyer mishandled the defense by skipping a computer expert. Prosecutors reply that he never showed what an expert would have found that could have changed the verdict.

They also dismiss his newer ask for an expert review of the evidence now calling it an "unreasonable fishing expedition."

Case background in the filings

Eloshway has said he accidentally pulled down the illegal files while looking for adult pornography on BitTorrent and compared that to junk mail. Prosecutors say jurors already heard that account and rejected it.

Investigators recovered over 7,000 files of child sexual abuse material according to the same filings. Prosecutors also say he admitted knowing such material could sit among files on his computer.

Prison term and other asks

His sentence is 121 months. The government argues his attorney helped him secure a lighter term than federal guidelines recommended.

He also wants emails between his former lawyer and prosecutors. Officials say he knowingly rejected plea deals and that those messages would not change the result.

Prosecutors ask the judge to reject the latest bid and keep the conviction and sentence intact.
