Bronx teen charged after FIT student dies from fentanyl she was told was cocaine
Prosecutors say a 19-year-old passed off fentanyl as cocaine in a New York City dorm and then raped a student who later died. His lawyer calls it a mistake.

Prosecutors say a New York City college student died after a teenager gave her fentanyl disguised as cocaine and then raped her in her dorm.
The charges
Moises Freire, 19, of the Bronx, is accused of joining a conspiracy to sell fentanyl. He is also charged with handing out a deadly drug while intending to commit rape. Authorities say it all happened on March 18.
What prosecutors allege
According to prosecutors, Freire showed up at a dorm room shared by two students with a drug he claimed was pure cocaine. It was really fentanyl.
Both women took it and passed out almost right away, prosecutors say. They allege Freire then raped one of them.
She slipped into a coma. She died on March 21, three days after the incident.
Two more men charged
Prosecutors charged two more men over the drug sales: Brian Peralta Cabrera along with Harry Rosales Pino. Neither one is accused of any part in the rape.
Pino has already pleaded guilty to conspiring to distribute narcotics that led to a death and serious injury. His sentencing is set for December.
The defense
Mitchell Schwartz, who represents Freire, told a judge his client was never trying to drug the women. He described what happened as a "dumb teenager" moment.
Freire has not been convicted of any crime.
