Judge throws out Morgan Carey's memoir defamation suit against sister Mariah
A judge tossed Morgan Carey's defamation case over Mariah Carey's 2020 memoir, finding he never adequately pleaded actual malice. He plans to appeal.

Mariah Carey has beaten her older brother in court. A judge on Monday dismissed the defamation case Morgan Carey filed against her, Billboard reports.
What the suit was about
Morgan objected to passages in her 2020 memoir "The Meaning of Mariah Carey." He said the book implied he dealt cocaine and was violent while they were growing up.
Why the judge tossed it
The court ruled he had not met the legal bar needed to sue his sister. In the judge's words, the claim did not "sufficiently plead actual malice" by the singer.
The ruling also said Morgan offered no evidence that Mariah knew she was writing something false about him.
Both sides react
Her attorney John Rosenberg told Billboard that Carey was pleased the court saw her memoir as dealing with important public issues. He noted every one of her brother's claims was thrown out.
Morgan's lawyer says the fight is not over. He told the outlet his client intends to appeal.
