Olivier Martinez says son Maceo took a photo of Halle Berry and now hopes to tell the judge his side
New filings from Olivier Martinez claim the 13-year-old photographed Halle Berry after a Sept. 26 clash and wants to speak to the judge. Berry denies abuse.

Olivier Martinez has filed fresh court papers in his custody fight with Halle Berry. He says Maceo, now 13, hopes to address the judge in person.
A photo as proof
According to the new documents, Maceo used his phone to take a picture of his mother after what Martinez describes as a physical confrontation at her home on Sept. 26. That incident kicked off the current custody battle.
Martinez says the boy had made similar accusations about Berry before. He claims Maceo felt those earlier complaints were brushed aside, so this time he wanted a picture to back up his account.
Pushback on her emergency filing
Martinez is also challenging the emergency request Berry filed on Oct. 5. He calls it "retaliatory" and says it gives the judge the wrong picture of Maceo's medical care.
In his telling, Berry cast him as a father blocking treatment for their son. He counters that Maceo's pediatrician and psychiatrist agreed on Sept. 21 that the boy should not be put on medication for now.
Martinez claims Berry knew about that decision and confirmed it in writing. He accuses her of pushing a false story to the court and to the public.
Maceo's wish to be heard
The filing says Maceo would like to share his custody preferences with the judge himself. Martinez also wants the court to hear the boy describe what allegedly happened at his mother's house before anything else is decided.
How the fight began
Martinez secured a temporary restraining order after saying Maceo told him Berry choked him during an argument over a virtual reality game. Berry has denied that claim and says the two were just roughhousing.
She has since finished a parenting program required by the court. The former couple is scheduled to return to court Friday. Berry's representatives have not responded to the latest filing.
