Sean Combs asks a judge to toss Clayton Howard's suit and says the escort chose every encounter
In new court papers Sean Combs argues former escort Clayton Howard was paid for sex and could have refused at any time, so his freak-off suit should be tossed.

Sean "Diddy" Combs wants a lawsuit from former male escort Clayton Howard thrown out. In new court papers he argues that Howard took part in the so-called freak-offs as a paid professional who was free to walk away.
The core argument
Howard, who has since become a law student, is suing both Combs and Cassie. The new filing brands his claims psychotic and reckless. It says plain common sense should decide whether they are believable at all.
Combs's side describes Howard as someone who was paid for sex as his line of work. It calls it absurd for him to claim that setting up the meetings, traveling to them and taking part were somehow forced on him.
The papers liken his services to a restaurant that offers dishes on the menu as well as special orders. If Howard did not like what was requested, the filing says, he alone had the power to change the order or decline it. Combs says Howard did neither.
No sympathy, Combs says
The filing casts Howard as an "enabler and exploiter" rather than a victim, someone willing to do whatever he was asked for money. It says he kept coming back for more sex and more cash and argues he deserves no damages.
Combs also claims Howard only went to court once the payments dried up. He is asking the judge to dismiss the case. Howard's allegations have not been proven in court.
Back at Fort Dix
The filing comes days after Combs was rushed out of prison for a medical emergency over the weekend. He has since been returned to the facility.
